When a debt collector communicates with a third party about a consumer’s debt after the collector has already had prior contact with the consumer, the collector must disclose that the sender is a debt collector and that any information obtained will be used for that purpose; the disclosure is not required on a first-party communication with the consumer themselves.
How Pleadwright enforces
The gate fires the Mini-Miranda block ONLY when the predicate `(commTarget === "third_party" && priorContact === true)` is satisfied — i.e. a debt-communication where the collector already has a documented touchpoint with the consumer and is now talking to (or about) a third party. First-party communications with the consumer and § 1692c(b)(1) location-only inquiries follow a separate disclosure regime and do not stamp the `MINI_MIRANDA` block. When the predicate fires, the block is paired inline with the § 1692g validation notice on the first written communication.
Why this rule is in the library
Section 1692e(11) remains the rule’s home authority — it sits inside the broader § 1692e ban on "false, deceptive, or misleading representations" and is the statutory anchor for the one-sentence "Mini-Miranda" warning. The predicate was narrowed because a Q0 counsel re-review found that the prior "every initial communication regardless of medium" framing over-fired: the § 1692c(b) communications-with-third-parties trigger is the real condition, and Reg F § 1006.6 separately governs initial consumer disclosures. Cross-pinning § 1692c(b) and 12 C.F.R. § 1006.6 in `fullCitation` keeps the multi-statute picture on the public surface without contaminating the `findRuleByStatuteCite` needle set (which still resolves 15 U.S.C. § 1692c(b) to the cease-communication rule, not Mini-Miranda). Pleadwright pre-inserts the block from `MINI_MIRANDA` so it cannot be elided by a paraphrasing prompt, and the agent audits each medium — print, voicemail, email, or text — against the narrowed predicate.
